(IN TERMS OF THE PROTECTION OF INFORMATION ACT, 4 of 2013)

Your privacy is very important to Mostert-Wademan Attorneys. We are strongly committed to protecting your right to privacy. Accordingly, we have developed this policy to explain how we obtain, make use of, and disclose the personal information that you submit to us, in accordance with the requirements of the Protection of Personal information Act, 4 of 2013 (“POPI Act”). 

Where we refer to “personal information”, it means personal information” as defined in the POPI Act, and “personal data” as per the General Data Protection Regulation 2016/679 (“the GDPR“). Personal information includes any information about a person that can be used to identify a natural person, and where it is applicable, an identifiable existing juristic person directly or indirectly. It includes information such as a name, an identification number, location information, e-mail address, telephone number or one or more factors specific to the physical, mental, and economic identity of that person.

The Information We Collect 

Your personal information may either be collected by us or provided by you. We collect and process your personal information mainly to assist you for the purposes of understanding your requirements and delivering legal services accordingly. For this purpose, we will collect personal details including, but not limited to, your name, organisation, contact details and any other reasonably required details relating to performing our legal services to you. The company will not collect additional information from you unrelated to this purpose.

We will ensure that your personal information in our control will be processed in a fair and lawful manner with your knowledge and consent. We do not process special personal Information about you unless you have provided the necessary consent for us to do so.

We process personal information mainly to deliver legal services to our clients, but also for, inter alia, purposes in connection with legal proceedings, record keeping, auditing practices, for the detection and prevention of fraud, crime, money laundering or any malpractices, as well as in relation to and to comply with legal and regulatory requirements (e.g. to comply with the Financial Intelligence Centre Act no. 38 of 2001), and whenever otherwise required by law. 

We do not collect or use personal information of children without the express consent of a parent or guardian, or if the law otherwise requires us to process such personal information.

How We Use Your Information

We will use your personal information only for the purposes for which it was collected and agreed upon by you. In addition, where necessary your information will be retained for legal purposes. The company will inform you of these purposes prior to collecting your personal information.

We will only retain your personal information until the fulfilment of those purposes, identified by us.

Disclosure Of Information

We may disclose your personal information to our service providers who are involved in the delivery of services to you. We may also disclose your information where we have a duty or a right to disclose in terms of law or industry codes and where we believe it is necessary to protect our rights.

Unless we obtain your voluntary and informed consent thereto, or unless it is required or permitted by law, we undertake to not sell, distribute, or disclose any personal information that you have disclosed to us.

Information Security 

We are legally obliged to provide adequate protection for your personal information in our possession, to prevent unauthorized access and use. We take all reasonable and appropriate measures to keep your personal information secure. While we cannot guarantee the absolute security of the information we hold, all personal information is backed-up on a regular basis. We will continuously review our security controls which include regular testing of protocols and measures put in place to combat cyber-attacks on the Company’s IT network. Should you be particularly concerned about the safety of specific personal information you intend to send to us, you should liaise with your contact person at the firm regarding the appropriate communication platform to be used.  

We will ensure that all paper and electronic records comprising personal information are securely stored and made accessible only to authorised individuals and destroyed adequately after the required period of retention.

All new employees will be required to sign employment contracts containing contractual terms for the use and storage of employee information. Confidentiality clauses will also be included to reduce the risk of unauthorised disclosures of Personal information for which the Company is responsible.

Your Rights: Access to Information

You have the right to request a copy of the personal information we hold about you. Amendment To Our Notice

We may amend our personal information practices and review this notice from time to time. Amendments will be communicated as necessary and will appear on our website.
