Parenting Plans

In terms of Sections 19 and 20 of The Children’s Act 38 of 2005, both parents have equal responsibilities and rights with regard to their children.  When separating, both parents have to agree on the terms of the care and contact arrangements as the co-holders of such rights.

Sections 33 and 34 make provision for parenting plans.   

A parenting plan is a written agreement entered into between the co-holders of parental responsibilities and rights setting out their arrangements in terms of the minor children’s residence, care, where and with whom the children are to live, contact times with the other parent during weekends, weekdays and holidays, co-guardianship, joint decision-making in terms of schooling, medical treatment, maintenance payable and further general practical arrangements.   

The parenting plan regulates the agreement between the parties and ensure that all parenting decisions and actions are in the best interests of the children.  

Section 10 of The Children’s Act provides that every child that is of such an age, maturity and stage of development as to be able to participate in any matter concerning that child has the right to participate in an appropriate way and views expressed by the child must be given due consideration.

When drafting parenting plans, we make provision for the appointment of a mediator or a parenting co-ordinator to assist the parties with future disputes.  It is important to choose the right parenting co-ordinator.   Full details of the choice of parenting co-ordinator will be discussed when we assist you with the drafting of your parenting plan.  

A parenting plan can be registered with the Offices of the Family Advocate, or made an Order of Court.
